These Terms of Service are a binding contract between you and the Robycal operator. They limit risk, define acceptable use, and protect the service against abuse, fraud, and bad-faith claims. If you do not agree, do not create an account or use the app.
1. Acceptance and contract
You accept these Terms by actively confirming them during account creation or when prompted after a material update (including version bumps shown in-app).
If you disagree with any part, you must stop using Robycal and may delete your account.
We may update these Terms. Material updates require re-acceptance before continued use where we elect that process.
These Terms apply together with the Privacy Policy and any in-app purchase disclosures shown by Apple.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter a binding contract.
Provide accurate registration information. Do not impersonate others or create accounts for others without authority.
One personal account per individual. Sharing, selling, renting, or transferring accounts is prohibited.
You are responsible for all activity under your credentials. Notify support@robycal.com promptly of suspected unauthorised access.
We may refuse, suspend, or terminate accounts that appear fraudulent, abusive, underage, or created to evade a prior ban.
3. Permitted use and prohibited conduct
Robycal is for personal fitness, nutrition logging, and related lifestyle tracking only—not commercial resale of outputs or API scraping.
Do not reverse engineer, copy, scrape, overload, probe, or disrupt the service, AI endpoints, or other users.
Do not upload unlawful, abusive, sexual, hateful, harassing, deceptive, or non-food content where food analysis is expected.
Do not attempt to bypass AI limits, rate limits, paywalls, moderation, App Check, or security controls.
Do not use Robycal to harass, extort, defraud, blackmail, or threaten Robycal, its operators, staff, partners, or other users.
Do not make false, exaggerated, or bad-faith complaints to Apple, payment providers, regulators, or courts solely to extract refunds, credits, or concessions.
Respect other users’ privacy in social features (profiles, messages, Flame Circle).
4. Health and medical disclaimer (read carefully)
Robycal is a consumer lifestyle/fitness tool. It is not a medical device, clinic, pharmacy, or emergency service.
Nothing in the app is medical advice, diagnosis, treatment, prognosis, or a substitute for care from a licensed clinician.
If you have or suspect a medical condition, eating disorder, injury, or pregnancy, consult a qualified professional before changing diet or exercise.
You alone decide whether and how to act on any estimate, plan, or suggestion in the app. You assume the risk of those decisions.
To the maximum extent permitted by law, Robycal and its operators are not liable for health outcomes, injuries, nutritional deficiencies, or other consequences of relying on the app.
5. AI estimates — no accuracy guarantee
Food photo analysis, calorie/macro estimates, workout suggestions, body metrics, and similar outputs are automated estimates and may be wrong, incomplete, or biased.
Lighting, packaging, portion size, mixed meals, labels, language, and model behaviour can all cause large errors.
You must review and correct results before logging. Saved data reflects your confirmation, not a certified lab measurement.
We do not guarantee any weight-loss, muscle-gain, performance, or health result. Past examples are not promises.
Service interruptions, model changes, provider outages, or feature limits may occur without liability beyond mandatory law.
6. Your content and licence
You retain ownership of content you submit (photos, messages, logs), subject to the licence below.
You grant Robycal a worldwide, non-exclusive, royalty-free licence to host, process, transmit, display, and create derivative technical outputs needed to operate and secure the service for you.
You represent that you have all rights needed to submit the content and that it does not infringe others’ rights or law.
We may remove, restrict, or refuse content that violates these Terms, App Store rules, or law, or that creates legal or safety risk.
Do not upload images of other people without a lawful basis, or any content intended to harm, coerce, or defame.
7. Social features and community safety
DMs, profiles, friend requests, Flame Circle, and similar features are optional and may be limited or disabled.
Harassment, spam, scams, impersonation, doxxing, sexual solicitation, and threats are prohibited and may lead to immediate bans.
We may preserve and review reports, logs, and related data as needed to investigate abuse and protect users and the service.
Public profile fields you choose to share are visible as described in-app; do not post sensitive personal data about yourself or others.
8. Subscriptions, payments, refunds, and chargebacks
Core logging may be used without a paid subscription, subject to fair-use and AI limits that we may adjust to protect the service.
Robycal Pro is an optional auto-renewable subscription billed through Apple (App Store / Apple ID).
Price, duration, trial (if any), and renewal terms are shown in Apple’s purchase sheet before you confirm. Apple is the merchant of record for App Store purchases.
Manage or cancel in Apple ID → Subscriptions. Refund requests are handled under Apple’s policies and applicable mandatory consumer law.
Abusive refund or chargeback patterns (for example: using Pro features then systematically disputing charges without a good-faith basis) may result in suspension, permanent ban, and denial of future paid access.
We may cooperate with Apple and payment partners to contest fraudulent chargebacks and to provide evidence of purchase, use, and Terms acceptance.
Unless mandatory law requires otherwise, fees already consumed for digital services rendered are non-refundable by Robycal directly.
9. Flames, shop items, and virtual benefits
Flames, badges, titles, frames, and similar in-app items or balances are virtual benefits with no cash value, unless mandatory law says otherwise.
They are not bank deposits, e-money, or property that you can redeem for money from Robycal.
We may change earn rates, shop catalogues, or balances for abuse prevention, economy balance, or operational reasons.
Lost, spent, or forfeited virtual benefits due to ban for Terms violations, fraud, or exploitation are not compensable except where mandatory law requires.
Exploiting bugs, scripts, or multi-accounting to farm flames or items is prohibited and may void balances and accounts.
10. Intellectual property
The Robycal app, branding, UI, code, models prompts/configurations we own, and related materials are protected by IP laws.
Except for your user content, you receive only a personal, revocable, non-transferable licence to use the app as provided.
Do not copy, redistribute, scrape training data, or commercially exploit Robycal without written permission.
If you believe content infringes your rights, contact support@robycal.com with details sufficient to evaluate the claim.
11. Disclaimer of warranties
To the maximum extent permitted by Romanian and EU law, Robycal is provided “AS IS” and “AS AVAILABLE”.
We disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, except where such disclaimer is not allowed.
We do not warrant uninterrupted, secure, or error-free service, or that defects will be corrected.
Third-party services (Apple, Google, Firebase, AI providers, RevenueCat, networks) may fail; we are not responsible for their outages beyond mandatory law.
12. Limitation of liability
To the maximum extent permitted by law, Robycal and its operators, officers, contractors, and partners are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages—including lost profits, data loss, goodwill, or business interruption—arising from the app or these Terms.
To the maximum extent permitted by law, our aggregate liability for all claims relating to the service in any 12-month period is limited to the greater of: (a) the amounts you paid to Apple for Robycal Pro in that period that are attributable to Robycal, or (b) EUR 50.
Nothing in these Terms excludes or limits liability that cannot be limited under applicable law (including mandatory consumer rights and liability for death or personal injury caused by proven negligence where such exclusion is forbidden).
You acknowledge that AI and fitness features involve inherent uncertainty and that the fee structure reflects these limitations.
13. Indemnity (your responsibility for misuse)
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Robycal and its operators from claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your misuse of the app; (b) your content; (c) your violation of these Terms or law; (d) your harassment or fraud toward others; or (e) baseless or abusive legal/payment disputes you initiate.
This indemnity does not apply where prohibited by mandatory consumer protection rules that protect you as a consumer.
We may assume exclusive defence of any matter subject to indemnity; you will cooperate reasonably.
14. Abuse, fraud, and evidence
We may investigate suspected abuse, fraud, scraping, multi-accounting, payment abuse, and Terms violations.
We may retain relevant logs, consent records, purchase metadata, device/app signals, and report materials as needed for security, dispute defence, and legal compliance (see Privacy Policy).
Threats of baseless lawsuits, regulatory complaints, or public smear campaigns to coerce refunds or special treatment may be treated as abuse and reported where appropriate.
We reserve all rights and remedies, including account termination, IP blocks where feasible, and civil claims for damages caused by malicious conduct.
15. Suspension and termination
You may delete your account at any time in Settings → Delete Account.
We may suspend or terminate accounts immediately for Terms violations, legal risk, non-payment fraud patterns, or harm to other users or the service.
Upon termination for cause, licences end and access may stop without refund except where mandatory law or Apple’s policies require otherwise.
Sections that by nature should survive (including IP, disclaimers, liability limits, indemnity, abuse, and governing law) survive termination.
16. Complaints and dispute process
Before filing a claim, contact support@robycal.com and allow a reasonable time (at least 30 days) for good-faith resolution, except where urgent injunctive relief is needed or mandatory law forbids this step.
EU consumers may use the European Commission’s Online Dispute Resolution platform where applicable: https://ec.europa.eu/consumers/odr
Nothing here waives mandatory consumer rights to bring claims in courts competent under EU/Romanian consumer rules.
Where you are acting as a business or outside mandatory consumer protections, you agree that courts of Romania have exclusive jurisdiction, and you waive class, collective, or representative actions to the extent permitted by law.
17. Governing law
These Terms are governed by the laws of Romania and applicable European Union law.
Consumers habitually resident in the EU retain mandatory protections of their country of residence that cannot be waived by contract.
If any translation conflicts with the English version for interpretation in international contexts, the English version prevails except where local mandatory law requires otherwise.
18. General
If a provision is invalid or unenforceable, the remainder stays in effect; the invalid part will be modified to the minimum extent needed to be valid.
Failure to enforce a right is not a waiver of that right.
You may not assign these Terms without our consent; we may assign to an affiliate or successor in connection with a reorganisation or sale.
These Terms, the Privacy Policy, and Apple purchase terms shown at checkout are the entire agreement regarding the app, superseding prior versions you accepted.
Headings are for convenience only and do not affect interpretation.
